These Terms of Service (“Terms”) govern your use of nativafronteira.com and any purchase of products or services from Nativa Fronteira Native Seed & Land Co., owned by Scott Walker. By using the Site you agree to these Terms.
1. Products and Services
We sell native seed, nursery plants and provide land restoration, landscaping and consulting services in Texas. Product descriptions, images and price ranges on the Site are provided for information and may change without notice. Final pricing is set in a written estimate or invoice.
2. Estimates and Orders
Estimates are valid for 30 days. An order or project is confirmed when you accept an estimate in writing and pay any required deposit. We reserve the right to decline any order.
3. Payment
Payment is accepted by credit card, check or ACH. Projects over $2,500 require a 30% deposit. Balances are due upon completion unless otherwise agreed. Late balances may incur a fee of 1.5% per month.
4. Scheduling and Weather
Field work depends on soil moisture and weather. We may reschedule work for safety or to protect planting success, and will notify you promptly.
5. Warranty and Limitations
We warrant that seed is labeled accurately according to Texas seed law and that services are performed in a workmanlike manner. Because plant establishment depends on rainfall, weather, grazing and site management outside our control, we do not guarantee specific stand density or growth results except as stated in a written agreement.
6. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim. We are not liable for indirect or consequential damages.
7. Website Use
You agree not to misuse the Site, attempt unauthorized access, or copy its content without permission. All text, photos and logos are the property of Nativa Fronteira or its licensors.
8. Governing Law
These Terms are governed by the laws of the State of Texas. Any dispute shall be resolved in the courts of Karnes County, Texas.
